America Wouldn’t Survive Abolishing the Filibuster and Stacking the Supreme Court
Democrats will end America if they do this.
Democrats are famous for proposing ideas that they think sound good with absolutely no concern for how they ultimately turn out. If say their, “We love puppies and orphans bill” gets them lots of praise from other liberals, they’re not going to care if it ultimately ends up causing hundreds of puppies and orphans to be tossed into a threshing machine. Gaining credibility and status with other liberals is everything to the Left and the actual results of their policies mean nothing.
This is why it’s so disturbing that getting rid of the legislative filibuster and stacking the Supreme Court has become a mainstream idea on the Left. That combination would inevitably lead to the end of America as a Republic, but there’s seemingly zero discussion of concern about that from anyone on the Left other than Kyrsten Sinema and Joe Manchin in the Senate.
This is pretty disturbing given that Manchin hasn’t decided whether to run for reelection yet in 2024 and may not win if he does while Sinema is facing a tough primary challenge in 2024 that could conceivably end her Senate career.
Meanwhile, this seems to be where mainstream thought is about this subject on the Left:
Granted, Adam Schiff is dumb as a box of rocks, but his position is a standard one in the Democrat Party despite the extremely dangerous way the whole thing is likely to play out.
Most liberals, being liberals, are only thinking one step ahead: “If we do this when we’re in charge, we can do things we want to do!”
What are they not thinking about?
How about the fact that the Founding Fathers deliberately designed the system like it is in order to keep the country stable and force both sides to cooperate to make changes? A system that can radically shift directions every time a different party comes into power is going to be hopelessly unstable. How do businesses adapt to that? How about the legal system? How do regular people plan out their lives when people who agree with Elizabeth Warren and AOC are making all the rules today and four years later, people who agree with Ted Cruz & Marjorie Taylor Greene are making all the decisions with no real limitations to their power? It’s a recipe for confusion, dysfunction, and disaster on a countrywide scale.
It’s also worth noting that stacking the SCOTUS would completely destroy the legitimacy of the Supreme Court, effectively end the role of the Constitution, and turn the court into a rubber stamp for Congress.
After all, liberals don’t believe in the Constitution, they believe in a “living constitution” which essentially just means making up rules that favor your side as you go along. If Democrats add 6 justices to the Supreme Court, they could literally pass ANYTHING. Outlawing guns? Making Cuba the 51st state? Ceding control of the United States to the UN? Confiscating half of everyone’s bank account? Anything they want will just be rubber-stamped.
Once we’re to that point, you could certainly expect red states to simply ignore any rulings they don’t like and treat the court as illegitimate. That would be a crisis that could very easily lead to widespread organized violence, and it would get worse because “originalism” is meaningless when the court becomes nothing but a rubber stamp for Congress. In other words, if Republicans took over under those circumstances, they would read the writing on the wall and would also start choosing hacks who’d do what they say and come up with legal reasoning for it later. This is essentially the same game every liberal justice plays now.
Worse yet, we would effectively no longer be a Republic, we’d be a representative democracy – and Ben Franklin was right about the problem with democracies:
In other words, if one side controlled the House, the Senate, and the Presidency, they could essentially do anything they wanted and historically, when people are in that situation, the first thing they usually do is ruthlessly suppress and exploit their enemies.
Of course, there would be consequences.
After all, most of the country is not either extremely conservative or extremely liberal, and shifting the country far off to either side is practically guaranteed to be wildly unpopular.
In other words, let’s say Democrats took full control of the House, Senate, Presidency, and Supreme Court. Their wish list would probably include things like banning guns, legalizing abortion up until birth everywhere, sky-high tax rates, socialized medicine, no new drilling for oil, banning coal, etc., etc. What would be the result of that? It would be the Democrats losing control of the House, Senate, and Presidency.
Then, what would be the first thing Republicans would do after they took over? They’d stack the Supreme Court themselves, reverse all the changes the Democrats made, and put their own radical changes into place, which would also turn out to be unpopular. It would be the same thing that’s happening now but on steroids. The American people essentially hate both parties and continually seem to decide that the lesser of two evils is whichever party isn’t in power.
However, there would be one enormous difference. Today, because we live in a Republic, both parties are constrained by the rules already in place, the court system, and the Constitution. Without a Senate filibuster or a real Supreme Court, there essentially would be no limits for a party that held the House, Senate, and Presidency.
So, if you have unlimited power, but you know that what you’re doing is unpopular and if the other party takes over, they will reverse it, what is the logical thing to do?
It’s to slant the system so heavily in your favor that the other side can NEVER take power again. Turn DC and Puerto Rico into states. Relax security around voting. Allow 15-year-olds to vote. Do anything and everything to suppress the Republican vote and increase the Democrat vote.
Would this happen right off the bat? Probably, yes. However, if it didn’t and Republicans took over, guess what? They’d have to be idiots not to rig the system in their favor. Once the rules have been changed and our Republic is over, it’s a matter of time until some form of authoritarian rule is inevitably coming. Better to have your hands on the levers of power when it does than to be in the crosshairs.
What happens from there? It’s hard to say for sure, but things like totalitarian rule with half the country being violently suppressed, civil war, or secession all become possible. What’s definitely NOT going to happen is that Republicans are going to be told that a bunch of radical socialists who hate our guts are going to be micromanaging our lives forevermore because voting them out isn’t an option and we’re going to respond to that by saying, “Ok, that sounds fine.”
Incidentally, the flip side is true, too. A bunch of mentally ill, Communist pronoun people in Portland, Berkeley, and Seattle are not going to spend the rest of their lives taking orders from Ron DeSantis and Jim Jordan. The country was never meant to work that way and it won’t.
Quite frankly, the whole country would be better off splitting up into regions and peacefully going our own way than getting rid of the Senate filibuster and rigging the Supreme Court. I would hope that even Democrats wouldn’t be foolish enough to Cross the Rubicon on those issues. However, there’s not much evidence that they’ve even spent 5 minutes thinking about the long-term implications of this, much less that they care enough about the country not to haphazardly destroy it just to get their way.
Deeply disturbing issues. It feels like a bad dream. When you have a media that acts as the propaganda arm of the Democrat party, there is no longer accountability. Thank you for being courageous and forthright.
I appreciate your comment about liberals thinking only one turn ahead. It's a reality that the mainstream media can't memory hole because even they have to admit that eliminating the filibuster of a supreme court nominee is what gave Trump the opportunity to empanel conservative justices, thank God. The Left is so mad for power, and so unable to see the results of their actions that I believe they will do something that suicidal to our republic, like pack the Supreme Court and add "welfare" states, it's only a matter of time. However I do believe they must still wait for a little while, though, because the old cold war communist fighters are not quite yet too old and decrepit to take up arms and fight back, but we're sure getting there. Thanks for sounding the tocsin/ringing the alarm bells about this nightmarish scenario!
